Privacy Policy

Hatod ("we," "us," or "our") operates the Hatod mobile application and website (collectively, the "Platform"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our Platform, in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines and its Implementing Rules and Regulations.

By using Hatod, you consent to the practices described in this policy.

1. Information We Collect

1.1 Information You Provide

  • Account Registration: Name, mobile number, email address, and password.
  • Identity Verification: Government-issued ID (for removing order limits and rider/seller verification).
  • Profile Information: Profile photo, delivery addresses, and saved locations.
  • Seller Information: Store name, business address, menu items, pricing, store photos, and operating hours.
  • Rider Information: Vehicle type, license plate number, driver's license, and vehicle registration.
  • Order Details: Items ordered, delivery instructions, papalit shopping lists, and pahatod package descriptions.
  • Marketplace Listings: Product descriptions, photos, and pricing for items you list for sale.
  • Transaction and Financial Data: Order amounts, commission records, delivery fee earnings, settlement history, and remittance records for Sellers, Riders, and Providers.

1.2 Information Collected Automatically

  • Location Data: Real-time GPS location (when the app is in use) for order delivery, rider tracking, and service area verification.
  • Device Information: Device model, operating system, unique device identifiers, and app version.
  • Usage Data: Pages viewed, features used, order history, and interaction timestamps.
  • Push Notification Tokens: For sending order updates and delivery notifications.

2. How We Use Your Information

We use your personal information for the following purposes:

  • Service Delivery: Processing orders, matching riders, facilitating deliveries, and enabling marketplace transactions.
  • Account Management: Creating and maintaining your account, verifying your identity, and enforcing order limits for unverified accounts.
  • Communication: Sending order updates, delivery notifications, receipts, and service announcements via push notifications and SMS.
  • Platform Improvement: Analyzing usage patterns to improve features, fix bugs, and enhance user experience.
  • Safety and Security: Detecting fraud, preventing abuse, and ensuring the safety of buyers, sellers, and riders.
  • Service Area Management: Determining your service area and connecting you with local stores, riders, and providers.
  • Financial Processing: Calculating commissions, tracking delivery fee earnings, managing settlement records between Riders, Sellers, Providers, and Hatod, and generating financial reports.
  • Legal Compliance: Meeting obligations under Philippine law, responding to legal requests, and enforcing our Terms and Conditions.

3. How We Share Your Information

We do not sell your personal data. We share information only in the following circumstances:

  • With Riders: Your name, delivery address, contact number, and order details are shared with the assigned rider to complete your delivery.
  • With Sellers: Your order details (items, quantities, special instructions) are shared with the store fulfilling your order. Your name and contact number may be shared if needed for order clarification.
  • With Service Providers (Area Managers): Local providers who manage your service area may access order and user data within their area for operational purposes.
  • With Marketplace Buyers/Sellers: When you transact on the marketplace, limited contact information may be shared to facilitate the transaction.
  • Legal Requirements: We may disclose information when required by law, court order, or government authority, or when necessary to protect our rights, safety, or property.

4. Data Storage and Security

  • Your data is stored on secure servers. We implement industry-standard security measures including encryption, access controls, and regular security assessments.
  • Government IDs submitted for verification are stored securely and used solely for identity verification purposes.
  • Payment information is not stored on our servers — all transactions are currently Cash on Delivery (COD).
  • While we take reasonable precautions, no system is 100% secure. We cannot guarantee absolute security of your data.

5. Data Retention

  • Active Accounts: We retain your personal data for as long as your account is active and as needed to provide services.
  • Order and Financial History: Transaction records, commission records, and settlement data are retained for a minimum of 5 years for operational, auditing, and legal purposes, in accordance with Philippine tax and commerce regulations.
  • Deleted Accounts: Upon account deletion request, we will delete or anonymize your personal data within 30 days, except where retention is required by law.
  • Verification Documents: Government IDs are retained for as long as your account is active and deleted within 30 days of account closure.

6. Your Rights

Under the Data Privacy Act of 2012, you have the following rights:

  • Right to Be Informed: You have the right to know how your data is being collected, used, and shared (this policy).
  • Right to Access: You may request a copy of the personal data we hold about you.
  • Right to Correction: You may request correction of inaccurate or incomplete personal data.
  • Right to Erasure: You may request deletion of your personal data, subject to legal retention requirements.
  • Right to Object: You may object to the processing of your personal data for certain purposes, including direct marketing.
  • Right to Data Portability: You may request your data in a structured, commonly used format.
  • Right to File a Complaint: You may file a complaint with the National Privacy Commission (NPC) if you believe your data privacy rights have been violated.

7. Location Data

Hatod requires location access to function properly:

  • Buyers: Location is used to determine your service area, calculate delivery fees, and provide your delivery address.
  • Riders: Real-time location is used during active deliveries for order tracking and route optimization. Location tracking is only active when the rider is online and accepting orders.
  • Sellers: Store location is used to display your store to nearby customers and calculate delivery distances.

You can disable location access in your device settings, but this will prevent core features from functioning.

8. Children's Privacy

Hatod is not intended for use by individuals under 18 years of age. We do not knowingly collect personal data from minors. If we discover that we have collected data from a minor, we will delete it promptly.

9. Third-Party Services

Our Platform may use third-party services for analytics, crash reporting, and push notifications. These services may collect information about your device and usage in accordance with their own privacy policies. We ensure that any third-party processors comply with applicable data protection standards.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the revised policy. We will notify you of significant changes through the app or email.
